Fault Versus No-Fault Divorce

Texas is a no-fault divorce state,

meaning that either party to a marriage can file for divorce for any reason, whether alleging fault on the part of the other spouse as grounds for the marital dissolution or not. Though you are not required to allege fault as a ground for divorce, a trial court can, in its discretion, consider any allegation of fault when determining the just and right division of community property.
